In Israel the right to a brokerage fee is not a matter of custom or a handshake: it is regulated by the Real Estate Brokers Law, 5756 1996, and the regulations enacted under it, and the law sets cumulative conditions without which the broker is not entitled to a single shekel. In this guide we have gathered what you need to understand before you sign: when the right to a commission arises, what must appear in the brokerage order, how much is customarily paid on a sale and on a rental, how VAT is calculated, what happens when there are two brokers, and how to read a brokerage services order with a critical eye.

The three legal conditions for real estate broker fees in Israel

Section 14 of the Real Estate Brokers Law provides that a broker is entitled to a brokerage fee from a client only if three conditions are met together. If any one of them is missing, the right to a commission does not arise, even if the deal was signed thanks to the broker.

A valid license. The broker must hold a valid brokerage license at the time the service is provided. Section 2 of the law prohibits engaging in real estate brokerage without a license, and doing so is a criminal offense. Before any engagement it is worth running the simple check we described in our guide on how to verify a broker’s license.

A signed written order. Under Section 9, the broker will not be entitled to a fee unless the client has signed a written order containing all the details set by the Minister of Justice in the regulations. The courts enforce this requirement strictly, and an order signed only after the information about the property had already been passed on may fail to meet it.

The effective cause. The broker must be the effective cause that brought the parties to enter into a binding agreement. It is not enough to have shown the property or sent an address; the question is whether the broker’s action actually led to the deal, or whether the connection between the parties was formed or matured through another source.

In practical terms: a brokerage commission is not a reward for effort but for a result, and only where the legal framework was in place in advance. A professional broker makes sure the order is signed before presenting the property, and a careful client checks that what they are signing truly reflects what was agreed.

The brokerage services order: what must appear on the form

The Real Estate Brokers Regulations (Details of a Written Order), 5757 1997, set out the minimum details that must appear in the order. An order missing a material detail may deny the right to a brokerage fee, so it is worth going through it clause by clause:

Names, addresses and ID numbers of the broker and the client.

The type of transaction sought, for example selling, buying, renting or letting.

A description of the property the brokerage concerns, in a way that allows it to be identified: the address, and sometimes the block and parcel (gush and chelka).

The estimated price of the transaction.

The agreed amount or rate of the brokerage fee, and whether the amount includes VAT or VAT is added to it.

Beyond the legal minimum, a good order also includes a date and signature, the name of the firm and the license number, and a clear definition of when the commission is payable. A buyer who receives a list of several properties from a broker should make sure every property shown appears in the order. A property not recorded there is one on which it is harder to claim a commission, and that is a situation neither the buyer nor the broker wants to discover after the fact.

How much you pay: real estate broker fees in Israel on a sale and a rental

The law does not set a rate. The amount of the brokerage fee is agreed between the client and the broker in each transaction, and what appears in the order is what binds. Still, the market has developed customs worth knowing as a reference point only:

Type of transaction

Common market practice

Who usually pays

Selling an apartment

Up to 2% of the transaction price, plus VAT

The seller, under the order they signed

Buying an apartment

Up to 2% of the transaction price, plus VAT

The buyer, under the order they signed

Rental

One month’s rent, plus VAT

The tenant, and sometimes the landlord as well

Luxury properties and large transactions

Usually a lower rate, by negotiation

As agreed with each party

In practice, broker fees on a sale usually range between 1% and 2%, and the larger the deal, the more the rate tends to be open to negotiation. In north Tel Aviv, where a four room apartment in Ramat Aviv Gimel or Bavli can cost millions of shekels, the difference between 1.5% and 2% is tens of thousands of shekels, so it is worth discussing openly before signing rather than afterwards. Rentals have no fixed rate either: for luxury apartments or long leases a different amount is sometimes agreed. Landlords who want the full picture, including pricing and the lease, will find details in our guide to renting out an apartment in north Tel Aviv.

VAT on brokerage fees

A broker who is a licensed dealer (osek murshe) must charge VAT on the brokerage fee. The VAT rate in Israel has been 18% since January 1, 2025, and it remains at this rate in 2026. The rate is set by the state and may change, so check it at the time of the transaction.

The key point is the wording. “2% plus VAT” and “2% including VAT” are two entirely different amounts, and on a large deal the difference is significant. That is why the regulations require the order to state whether VAT is included. If the wording is vague, ask for it to be corrected before signing. In transactions by companies or businesses, VAT may be recognized as input tax, and on this question it is worth consulting an accountant.

A worked example: a sale in Ramat Aviv Gimel and a rental in Tzahala

The following examples are for illustration only. The rates in each transaction are agreed and set out in the order.

Selling an apartment for ₪5,200,000

An agreed rate of 2% plus VAT: ₪104,000 in brokerage fees, plus ₪18,720 VAT, for a total of ₪122,720.

An agreed rate of 1.5% plus VAT: ₪78,000, plus ₪14,040 VAT, for a total of ₪92,040.

An agreed rate of 2% including VAT: a total of ₪104,000, of which about ₪88,136 is commission and about ₪15,864 is VAT.

The same deal, three wordings, and a gap of more than ₪30,000 between the extremes. If the buyer also worked with a broker and paid a similar rate, each party pays according to the order they themselves signed.

A rental at ₪9,500 a month

A commission of one month’s rent plus VAT: ₪9,500 plus ₪1,710 VAT, for a total of ₪11,210. Make sure the basis for the calculation is the rent alone, without building maintenance fees (vaad bayit), municipal tax (arnona) or a separate parking payment, unless agreed otherwise in writing.

When the brokerage fee becomes due

The right to a brokerage fee arises when the parties enter into a “binding agreement”, in the words of Section 14. In most transactions this means signing the sale contract or the lease, and the custom is to pay at or close to the signing, as set out in the order.

Several situations require attention:

A memorandum of understanding (zichron dvarim). Such a document may be considered a binding agreement if it contains the material details of the deal and a clear intention to be bound. Signing one may therefore give rise to the right to a commission already at that stage.

Cancellation of the deal after signing. As a rule, the right to a commission arises with the binding agreement, and a later cancellation does not automatically void it. The answer depends on the circumstances and the wording of the order, and in such a case it is worth consulting a lawyer.

A deal signed after the order expired. If a buyer introduced by the broker returns a few months later and signs directly with the seller, the question is whether the broker is still the effective cause. Bypassing a broker to save the commission often ends up in court.

Exclusive listings: the periods and marketing actions the law requires

Exclusivity means that the seller places the property in the exclusive care of a single firm for a defined period. The law recognizes it, but surrounds it with clear protections for the seller. The broader picture of what exclusivity is and how it fits into the process appears in our guide on how apartment brokerage works. Here we focus on what the law requires:

A separate document. The grant of exclusivity and its period must be confirmed by the client’s signature on a separate document. An exclusivity clause buried in small print inside the general brokerage form does not meet the requirement.

Maximum period. When a seller who is not in the real estate business grants exclusivity on an apartment, the period may not exceed six months from the date of the order. For properties that are not apartments, check the applicable rules with a lawyer.

Actual marketing actions. The Real Estate Brokers Regulations (Marketing Actions), 5765 2004, require the broker to carry out at least two marketing actions from a list, unless the parties agreed on other marketing methods.

Early termination. If the broker has not carried out the marketing actions by the end of one third of the exclusivity period, the exclusivity ends on that date.

What counts as a marketing action under the regulations

Placing a sign on or near the property, or on a public notice board.

Publicizing to a client base by electronic means or direct mail, or an advertisement on a website.

Advertising in a widely circulated daily newspaper, a regional newspaper or a newspaper for a specific target audience.

Inviting potential buyers to view the property.

Inviting at least five other brokers active in the locality where the property is situated to cooperate in the sale.

Any other marketing method agreed between the parties.

Exclusivity also has a direct effect on the brokerage fee: under Section 14(b), a broker who carried out the prescribed marketing actions during the exclusivity period enjoys a presumption that they are the effective cause of a deal signed during that period. In other words, a seller who found a buyer on their own during a valid exclusivity may still owe the commission. This is a good reason to grant exclusivity only to a firm that presents a real marketing plan, and to document what was carried out. At RS Nadlan we manage the marketing of the properties in our care according to a defined plan, and property owners can read about it on our page for property owners who want to sell.

Two brokers in the same deal

There are two very different situations, and it is important to distinguish between them.

A broker for each side

This is the common situation: the seller works with one firm, the buyer with another, and sometimes the two firms cooperate. Each client pays their own broker according to the order they signed. There is no double payment here, because each party pays once.

Two brokers dealing with the same client

The problematic situation is when a buyer has signed orders with two firms, and both presented the same apartment. The guiding rule in case law is that a client should not pay twice for the same deal, and the court examines which of the two was the effective cause. Sometimes one of them is found entitled to the full commission, and sometimes the commission is divided between them according to their contribution. To avoid this:

When a broker offers a property you have already seen or already received details about, say so immediately and in writing.

Keep organized records: who presented which property and on what date.

Do not sign an order that includes a property already presented to you by another source without noting it.

Disputes over brokerage fees and how to avoid them

Disputes over brokerage fees usually stem from three sources: an order that is incomplete or was signed late, an argument over the effective cause, and unclear wording of the commission rate or the VAT. Such a dispute can go to the small claims court when the amount is below its set ceiling, or to the magistrate’s court when the amount is higher. A complaint about a broker’s conduct, for example operating without a license or breaching the duty of loyalty, can be filed with the Registrar of Real Estate Brokers at the Ministry of Justice.

It is also worth remembering the duties the law places on the broker: Section 8 requires them to act loyally and fairly and to give the client any material information known to them about the property, Section 10 prohibits them from brokering a deal in which they have a personal interest without disclosure and written consent, and Section 12 prohibits them from drafting legal documents for the transaction. The contract itself is drafted by a lawyer, and any specific legal question should be checked with one. RS Nadlan does not provide legal or tax advice.

How to read a brokerage services order before you sign

Five minutes of reading before signing can save entire arguments later. This is the checklist we recommend:

Do the broker’s name and license number appear, and is the license valid?

Is the type of transaction correct: sale, purchase or rental?

Does every property that has been or will be shown to you appear in the description, with an exact address?

Is the brokerage fee rate written as a number, and is it clear whether VAT is included or added?

What is the basis for the calculation: the transaction price in the contract, or a price that also includes extras such as parking and storage?

When is payment due: on signing a memorandum of understanding, on the contract, or at another time?

If there is exclusivity: is it in a separate document, what is the period, and which marketing actions does the firm undertake to carry out?

Is there a clause that makes the commission payable even after the order ends, and for how long?

If anything on the form is unclear, ask for an explanation in writing or a correction. A professional broker will not shy away from these questions, and how they answer is also a good test of how they will handle the entire deal.

Frequently asked questions

What percentage in broker fees is paid on the sale of an apartment?

The law does not set a rate. Market practice is up to 2% of the transaction price plus VAT, and in practice the rate usually ranges between 1% and 2% and is agreed in each deal. The binding rate is the one written in the order you signed.

Do I have to pay a brokerage fee without a signed order?

Under Section 9 of the law, a broker is not entitled to a brokerage fee if the client did not sign a written order containing the details set in the regulations. Each case is examined on its merits, and in a dispute it is worth consulting a lawyer.

How much is the brokerage fee on a rental?

The common practice is one month’s rent plus VAT, usually paid by the tenant. Here too this is a custom, not a legal obligation, and the amount is agreed and set out in the order.

When is the brokerage fee paid?

The right to a commission arises when the parties sign a binding agreement, and payment is usually made at or close to the signing of the contract. A detailed memorandum of understanding may be considered a binding agreement, so it is important to check what the order says about the payment date.

How long can exclusivity on an apartment last?

When a seller who is not in the real estate business grants exclusivity on an apartment, the period may not exceed six months from the date of the order. If the broker has not carried out the prescribed marketing actions by the end of one third of the period, the exclusivity ends.

Do brokerage fees include VAT?

It depends on the wording. The order must state whether the amount includes VAT or VAT is added. The VAT rate has been 18% since January 2025, and as of 2026 it has not changed.

Before you sign

Fair brokerage fees are fees agreed in advance, written clearly and reflecting real work.
