A seller weighing whether to work with an exclusive listing agent in North Tel Aviv should first understand the legal framework. Exclusivity is not just a verbal understanding with one agency: the Real Estate Brokers Law sets out how it is granted, how long it can last, what the agent must do during that period and when it ends on its own. Anyone who understands the rules can assess an exclusive listing agent in North Tel Aviv by what is written in the document rather than by the promises made in conversation. In this guide we read the relevant sections, see how they work on a calendar, and go through the clauses worth checking before signing. The rules on brokerage fees themselves, how much is paid and when, are set out in our guide to brokerage fees, so we will not repeat them here.
What exclusivity is, and how it differs from a brokerage services order
All work with an agent begins with a written brokerage services order. Without a signed order, under section 9(a) of the law, the agent is not entitled to a brokerage fee. An ordinary order does not prevent the seller from working in parallel with other agencies or selling independently.
Exclusivity is an additional layer. Under section 9(b), an agent may agree with a client that a particular transaction will be placed in the agent’s exclusive care, on two conditions: the exclusivity and its period are confirmed by the client’s signature on a separate document, and during the period the agent carries out marketing actions. In practical terms, an exclusivity clause that appears as a line inside the general order form does not meet the requirement of the law. A seller should see a separate document, read it and sign it separately.
What the law says about the exclusivity period
Section 9(b1) applies when the property is offered for sale by a seller not in the course of business, meaning a private owner rather than a developer or a company engaged in real estate. The rules are:
| Situation | What the law provides |
|---|---|
| Apartment, period set | No more than six months from the date of the order |
| Apartment, no period set | Exclusivity ends 30 days from the date the order was signed, under section 9(c) |
| Property other than an apartment, period set | No more than one year from the date of the order |
| Property other than an apartment, no period set | Exclusivity ends nine months from the date of the order |
| The agent did not carry out the marketing actions | Exclusivity ends at the close of one third of the period, under section 9(b2) |
What counts as an apartment, and why it matters in the north of the city
The law defines an apartment as a room, structure or set of rooms intended for residence or actually used for residence, including those to be built in the future. The definition is broad: it covers an apartment in a building, a penthouse, a garden apartment, and also a private house. In other words, a villa in Tzahala or Afeka sold by a private family is an apartment for exclusivity purposes, and its maximum period is six months, even for a luxury property that takes time to market. A vacant plot, an office or a shop are other types of property, and the one year ceiling applies to them.
The marketing actions the agent must carry out
The Real Estate Brokers Regulations (Marketing Actions), 2004 provide that during an exclusivity period the agent will carry out at least two actions from a closed list of six: signage, publication to the public in the agent’s database or on a website, publication in a daily newspaper, publication in a regional newspaper or to a target audience, inviting buyers or agents to view the property, and cooperation with at least five agents active in the locality. In addition, the parties may agree on a seventh action not on the list, together with the other actions or in their place.
Two points in the regulations are less well known, and both matter to the seller:
- A separate form for the marketing actions. Under regulation 1(b), the agent must set out in a form separate from the order all the actions on the list, and state that the client may agree with the agent on the actions to be carried out. If an action outside the list was agreed, it must be stated separately.
- Marketing can be tailored to the property. Owners of villas and luxury apartments in the north of the city do not always want a sign on the house or an open listing with the address. You can choose other actions from the list, such as presentation to clients in the agent’s database and coordinated viewings, and you can define an agreed action suited to discreet marketing. The key is that the choice is in writing.
Cooperation with five other agents is one of the actions on the list. This means exclusivity is not necessarily closing the property off from other agencies, but concentrating responsibility in one agency that manages the marketing and the coordination.
The first third: how early termination works on a calendar
Section 9(b2) is one of the strongest protections for the seller. If the agent has not carried out the agreed marketing actions by the end of one third of the exclusivity period, the exclusivity ends on that date, with no need for notice or consent.
An illustrative example
The example is for illustration only. The owners of an apartment in Tel Baruch North sign an order and an exclusivity document on November 1, 2026, for a period of four months, until February 28, 2027. In the marketing actions form they agreed on publication on a website and inviting buyers to view the property.
- The whole period is about 120 days, and a third of it is about 40 days, that is, until about December 10, 2026.
- If by then the agent has not published the property on a website and has not invited buyers to a viewing, the exclusivity ends on that date, and the seller is free to work with other agencies as well.
- If the actions were carried out, the exclusivity continues until the end of February.
- Had no period been set in the document at all, the exclusivity would have ended after 30 days, on December 1, 2026.
So it is worth keeping records: a dated screenshot of the listing, the list of viewings, the notice to the cooperating agents. These records serve both sides if a dispute arises.
Selling on your own during the exclusivity period
This is the question sellers ask most: what happens if during the exclusivity the seller finds a buyer independently, for example a neighbor or a relative. Section 14(b) provides that an agent who carried out the agreed marketing actions during the exclusivity period enjoys a presumption that the agent was the effective cause of a transaction concluded during that period. In effect, the burden shifts to the seller.
A presumption can be rebutted. A seller who proves that the buyer came entirely independently, with no connection to the agent’s actions, may be released from liability, but that is an evidentiary battle best avoided. The right way is to settle it in advance in the document:
- A list of exclusions. If there are people who had already expressed interest in the apartment before signing, it is worth listing them by name in the exclusivity document and defining what applies if one of them buys, and within what time frame.
- What happens after the period ends. A buyer the agent introduced during the exclusivity period who signs after it does not trigger the presumption, but the agent may still argue under the ordinary rule that the agent was the effective cause. It is worth understanding this in advance and not trying to time a signature to get around it.
Commission rates, VAT and the timing of payment are set in the order and explained in our guide to brokerage fees.
Clauses to check before signing with an exclusive listing agent in North Tel Aviv
Before signing an exclusivity document, go through these points one by one:
- Explicit start and end dates. Not just “six months”, but a date. That way there is no argument about when the one third point falls.
- A separate document and a separate marketing actions form. Both forms, each with its own signature.
- Defined marketing actions. What exactly will be done, on which channels, and what was agreed about a sign and publishing the address.
- Asking price and flexibility. The price at which you go to market and how a decision to change it is made. The decision on price is always the seller’s.
- Exclusions. Names of potential buyers who preceded the exclusivity.
- All owners sign. When there are several owners, such as spouses or heirs, the exclusivity must be agreed by all of them; otherwise it may not bind anyone who did not sign.
- Termination and compensation clause. If there is a compensation clause for the case where the seller cancels early or decides not to sell, understand its scope and check that it is reasonable with a lawyer.
- License. The agent’s name and license number. This is easy to check by following our guide on how to check a brokerage license.
Early termination, renewal and common disputes
When the seller wants to end early. The law does not set an explicit mechanism for cancelling exclusivity at the seller’s initiative when the agent is meeting the agent’s obligations. The relationship is assessed under the document and under contract law, so the wording of the termination clause matters. If the agent did not carry out the marketing actions, the exclusivity ends in any case under the one third rule.
Renewal. At the end of the period the exclusivity ends. If the parties want to continue, the right course is to sign a new exclusivity document with a new period and updated marketing actions, rather than relying on a verbal extension. It is also an opportunity to review what worked in the first period.
The common disputes. Most disagreements stem from a lack of records: no proof the marketing actions were carried out, no clear start date for the period, or a buyer who came into the picture through someone else with no list of exclusions. Each of these is avoided by orderly drafting in advance.
Three mistaken assumptions about exclusivity
- “Exclusivity obliges me to sell.” No. Exclusivity determines who markets the property and on what terms, but the decision whether to accept an offer stays with the seller. What may be binding is a compensation clause, if one was written, so it is important to read it.
- “If nothing is written, exclusivity lasts six months.” The opposite. For an apartment, when no period was set, exclusivity ends after 30 days. Six months is the ceiling, not the default.
- “Exclusivity means no other agent will see the property.” Not necessarily. Cooperation with other agents is one of the marketing actions in the regulations, and it widens the circle of buyers. The question is who manages the process, not how many agencies know the property.
Anyone who remembers these three points reads an exclusivity document differently: looking for dates, actions and a termination clause, and not settling for the heading.
When an exclusive listing agent in North Tel Aviv serves the seller
Exclusivity does not suit every property or every seller. It tends to serve the seller when the property needs planned marketing and not just a listing, for example a villa in Tzahala, a penthouse or a large apartment with a narrow target audience; when it matters to the seller to have one point of contact for marketing, coordinating viewings and negotiation; and when discretion is needed, with one agency controlling the information that reaches the market. It is less suitable when the seller is not sure they want to sell, or when there is no written marketing plan that can be reviewed.
The practical side, meaning what happens week by week during an exclusivity period and how price is adjusted along the way, is described in our article on exclusive listings in Ramat Aviv Gimel. At RS Nadlan we manage exclusive marketing according to a written plan agreed with the property owner in advance.
Frequently asked questions
How long can you give an agent exclusivity on an apartment?
When the seller is a private owner, up to six months from the date of the order. If no period was written in the document, the exclusivity ends 30 days from the date of signing.
Is a private house considered an apartment for exclusivity purposes?
Yes. The definition in the law covers any structure intended for or used for residence, so a villa or a cottage is also limited to six months when the seller is not in the real estate business.
What happens if the agent does nothing during the exclusivity period?
If the agent has not carried out the agreed marketing actions by the end of one third of the period, the exclusivity ends on that date by force of law. It is worth documenting what was done and what was not.
Can you sell on your own during an exclusivity period?
You can, but if the agent carried out the marketing actions, there is a presumption that the agent was the effective cause, and the seller may be liable for the commission. It is worth listing in advance, in the document, an exclusion for buyers who were in the picture before signing.
Is an exclusivity clause inside the order form valid?
The law requires that the exclusivity and its period be confirmed by signature on a separate document. A clause built into the general form does not meet this requirement. In a specific case, it is worth consulting a lawyer.
